SPECIFIC TERMS OF SALE
This sale of this Real Property will be an
Auctions-West “e-Auction”. An “e-Auction” is a silent, eBay-style
auction that occurs exclusively on the Auctions-West Internet site (as
opposed to live or via satellite) where the Auctions-West web site acts
as auctioneer. Bidding is permitted during a specific period of time.
Asking bids are presented as a pre-determined increment above the
current bid. The conclusion of the sale occurs at a specific,
pre-ordained time. Bidders are given fair warning regarding the exact
time of conclusion. At the conclusion of the sale, the high bidder will
be the successful bidder, unless the property in question was sold with
a reserve price that was not met by the high bid. The Auctions-West web
site will provide notice to bidders if their bid has failed to surpass
the reserve price. Bidders will also be notified by e-mail if they have
been outbid.
Only if you have a bidder number and
password, and are pre-qualified for this sale, will you be allowed to
bid.
This “e-Auction” will require a credit approval
for at least $_(Specified on individual properties) for
bidders to be able to bid on the Real Property. The winning bidder
will send a Cashiers check or a wire transfer in the amount of $_(Specified
on individual properties) made out to Omni West Real Estate, LLP
or assigns. Said funds will be required to be sent to Omni West Real
Estate, LLP within 48 hours of the close of the Auction.
TERMS Cash to seller.
The auction of the Real Property will close at the
appointed Time (Specified on individual properties) at
5:00pm.
The successful bidder will need to sign the Real
Estate Purchase Contract and due diligence documents within 24 hours
of the close of the auction. The escrow shall close no later
than Date specific to specific property.
In the event of default of the buyer, the $(Specified
on individual properties) shall become liquidated damages to
Auctions-West, Inc. and the seller.
Bidders are required to conduct any research or due
diligence prior to making a bid. Bidders are encouraged to
physically inspect the site during the viewing period (Specified
on individual properties) by
appointment only). However, property may be inspected at buyer’s
convenience by appointment only. Bidders need to contact their assigned
Auctions-West, Inc. representative for a date and time to view the
property.
Buyer’s premium on this Real Property is 5% (five
percent). The buyer’s premium is added to the bid price to determine
the total amount due from the buyer.
Auctions-West, Inc. is a DBA of Shasta Land
Services, Inc. a California Real Estate Brokerage acting as a Real
Estate Broker representing the seller in this auction, along with the
listing broker Omni West Real Estate, LLP a licensed Colorado real
estate broker. Bidders who have legal questions should contact an
attorney. Those that desire real estate information & guidance should
contact a licensed Real Estate Broker to assist them in doing their
investigation.
Bidders must do their investigation and due diligence
prior to bidding. Once the auctioneer (in this case, the Auctions-West
web site) sells the property to the successful bidder at the close of
the auction, the bidder is assumed to have done all their
investigating and is buying the property “as is.” The
information given bidders in the due diligence packages is supplied by
the various sources deemed reliable, but Shasta Land Services, Inc. and
Auctions-West, Inc, and Omni West Real Estate, LLP a licensed Colorado
real estate broker, do not assume responsibility for
its accuracy
or completeness. A prospective buyer should verify all data to his/her
own satisfaction and seek the advice of legal counsel on issues such as
water rights, leases, tax consequences, zoning, etc. Buyer is to rely
solely on his/her independent and due diligence as to the feasibility of
the property for his/her own purposes. Maps included in this brochure
are for general information only and, while believed to be substantially
accurate, are not of "survey" or expert quality. Property is subject to
prior sale, price change, correction, or withdrawal from the market
without notice.
Upon acceptance of an offer, the Buyer (s) will
enter into and sign a Contract to Buy and Sell Real Estate
- All types of Properties (an approved form of the Colorado Real
Estate Commission) for the amount of the offer. Required earnest money
deposit in the amount predetermined in the Listing contract in the form
of cash or check is due upon signing of the contract made payable to
Omni West Real Estate, LLP or assigns. The balance of terms related to
title, finance, deed, closing date, surveys, appraisal, rents, growing
crops, unpaid taxes, FSA determinations, minerals, acreages, possession
and any other contingencies will be contained within the Contract to Buy
and Sell Real Estate (All types of Properties).
Acceptance or rejection of Buyer’s additional
provisions, contingencies, terms and price will be at the sole
discretion of the Seller. Less favorable terms accompanying the highest
bid may induce the Seller to accept a lower bid with more favorable
terms and fewer contingencies.
Brokerage: Omni West Real Estate, LLP and any other
Broker involved will be acting as a Transaction Broker.

Forms to be signed by Buyer and Seller have
been approved by the Colorado Real Estate Commission
